Contracts can provide a defense against construction defect claims

Contractors do important jobs for their clients, and those jobs are often costly. While many projects are completed successfully, there are times when contractors find themselves facing a construction defect claim. 

Construction defects can stem from a host of issues. These include things like substandard materials, poor workmanship, unexpected delays and improper completion of the project. Finding ways to defend construction defect claims must be a priority. 

Have a comprehensive contract

A comprehensive contract can take out the possibility of having issues stemming from uncontrollable delays, claims of not doing the project correctly or other issues. The more information that’s in this contract, the more protection comes for your company. If anything about the project changes, the contract must change to reflect that. Additionally, there should be resolution methods stipulated in the contract. 

Use skilled labor and quality materials

Always use skilled labor and quality materials to combat claims of unsuitable workmanship. If you use subcontractors, keep an eye on them to ensure that they are working up to your standards and what the client will expect. 

Document the project

Documenting the project may make it possible to show that the defects being cited aren’t present. This can be done by taking pictures at various points. Try to focus on capturing the quality of the workmanship and the suitability of the materials. 

Construction defect claims must be addressed quickly. It’s important to have someone to assist with a defense strategy, particularly if the case goes to court.
